1. About these terms
These Terms of Service govern your use of the Memsy service offered by Quincom Ecommerce - FZCO, Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates (operating the "Memsy" service; "Memsy", "we", "us"). By creating an account, starting a subscription, or otherwise using the service, you agree to these terms. Full provider details are available in our Legal Notice.
2. What Memsy does
Memsy is a subscription service that (a) automatically curates photos from a WhatsApp group you authorise us to listen in on, and (b) prints and ships a custom hardcover photo book to your address at the cadence you select (monthly, quarterly, biannual or annual).
3. Account, eligibility and contract formation
You must be at least 18 years old to enter into a subscription contract with Memsy. The contract is formed when you complete checkout via our payment processor (Stripe) and receive an order confirmation from us. During checkout you expressly acknowledge that the service begins immediately and that printed books are non-refundable (see Section 6).
4. Prices and payment
Prices shown on the Memsy website at the time of order include applicable taxes and shipping to addresses within the United States, Canada, and the EU. Charges recur on the cadence you selected and are processed by Stripe. Memsy never stores your card number.
5. Subscription term and cancellation
Your subscription has no minimum term. You can cancel at any time from your dashboard or by emailing hello@memsy.app. Cancellation takes effect at the end of your current billing period; any book already in production for that period will be finished and shipped to you, and no further charges or books will be generated thereafter.
6. Refunds and returns (all sales final on printed books)
Every Memsy photo book is custom-made to your order from photos that you and your family have shared in your private WhatsApp group. For this reason all printed books are final sale and are not eligible for return, exchange, or refund once production has started. You agreed to this term during checkout, and this disclosure is provided in advance of purchase to comply with state-level requirements including California Civil Code § 1723 and New York General Business Law § 218-a.
Defective or damaged books are covered: contact us within 14 days of delivery for a free reprint or refund. The full policy, including the rules for cancelling a subscription before the next cutoff date, is available on our Refund & Returns Policy page.
7. Content and image rights
You represent and warrant that you hold all necessary rights in the photos shared in your WhatsApp group and used in your Memsy book, and that you have the consent of every person depicted, including the consent of a parent or legal guardian for any minors. Memsy acquires no commercial rights in your photos and uses them only to produce your book.
8. Acceptable use
You will not submit content that is unlawful, infringing, sexually explicit, or that depicts minors in a sexualised manner. Every uploaded image is automatically screened by an AI moderation service; suspected CSAM is reported to NCMEC as required by US federal law.
9. Limitation of liability
To the maximum extent permitted by applicable law, Memsy's aggregate liability arising out of or in connection with the service is limited to the amounts paid by you to Memsy in the twelve months preceding the event giving rise to the claim. This limitation does not apply to liability that cannot be limited by law (such as for gross negligence or intentional misconduct).
10. Governing law and disputes
These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. For consumer customers, mandatory consumer protection rules of your country of residence remain unaffected. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. Memsy is not obliged and not willing to participate in out-of-court dispute resolution before a consumer arbitration board.
11. Changes to these terms
We may update these terms from time to time. Material changes will be communicated to you by email at least 30 days before they take effect. If you do not agree to a material change, you may cancel your subscription before the change takes effect.
